1. Acceptance

By accessing or using DESIGNmd ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

DESIGNmd is an open platform for discovering, sharing, and downloading DESIGN.md files — portable, markdown-based design systems. The Service includes the website, API, CLI tool, and MCP server.

3. Accounts

You must sign in with a valid GitHub account to upload content, like kits, or create collections. You are responsible for all activity under your account.

You agree to provide accurate information and not to impersonate others. We reserve the right to suspend or terminate accounts that violate these terms.

4. User Content

Ownership: You retain ownership of the content you upload. By uploading a design system, you grant DESIGNmd a non-exclusive, worldwide license to host, display, distribute, and make your content available to other users in accordance with the license you select (MIT, CC0, CC-BY, CC-BY-SA, or custom).

Responsibility: You are responsible for ensuring you have the right to share content you upload. Do not upload content that infringes on others' intellectual property rights.

Content review: Uploaded content is automatically scanned for safety. We reserve the right to remove content that violates these terms, contains harmful material, or is flagged by our safety systems.

5. Acceptable Use

You agree not to:

  • Upload malicious code, malware, or content designed to harm others
  • Use the Service to distribute spam, phishing, or deceptive content
  • Attempt to gain unauthorized access to other accounts or systems
  • Scrape or crawl the Service in a way that degrades performance for other users
  • Use the Service for any illegal purpose
  • Circumvent rate limits, safety scans, or other protective measures

6. API & MCP Usage

Access to the DESIGNmd API and MCP server is provided for legitimate integration purposes. API keys are personal and must not be shared. We may rate-limit or revoke API access that is abusive or excessive.

7. Intellectual Property

The DESIGNmd name, logo, and website design are the property of DESIGNmd. Design systems uploaded by users are governed by their respective licenses as chosen by the uploader.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We do not endorse or verify the quality, accuracy, or safety of user-uploaded design systems.

9. Limitation of Liability

To the fullest extent permitted by law, DESIGNmd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, profits, or business opportunities.

10. DMCA & Takedowns

If you believe content on DESIGNmd infringes your copyright, please file a report through our reporting system or contact us via our GitHub repository. We will review and respond to valid takedown requests promptly.

11. Termination

You may delete your account at any time through Settings. We may suspend or terminate your account if you violate these terms. Upon termination, your content will be removed in accordance with our Privacy Policy.

12. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via a notice on the site. Continued use of the Service after changes constitutes acceptance of the updated terms.

13. Governing Law

These terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation before pursuing formal proceedings.
